CoVID-19 containment and emergency management measures valid throughout the country

Yesterday, 11 March 2020,the President of the Council of Ministers, Giuseppe Conte,signed a new Dpcm with measures to counter and contain the spread of Coronavirus.

The measures are valid throughout the country.

This is the text of the decree:

II PRESIDENT OF THE COUNCIL OF MINISTERS

Under the law 23 August 1988, 400;

In view of the decree-law 23 February 2020, No 6, with 'urgent measures on the containment and management of the epidemiological emergency from COVID-19' and, in particular, Article 3;

Given the decree of the President of the Council of Ministers 23 February 2020, bearing "Implementation provisions of the Decree-Law 23 February 2020, No 6, bearing urgent measures in relation to the containment and management of the epidemiological emergency from COVID-19", published in the Official Journal 45 of 23 February 2020;

Given the decree of the President of the Council of Ministers 25 February 2020, bearing "Additional implementing provisions of the Decree-Law 23 February 2020, No 6, bearing urgent measures in relation to the containment and management of the epidemiological emergency from COVID-19", published in the Official Journal 47 of 25 February 2020;

Given the decree of the President of the Council of Ministers 1 March 2020, bearing "Additional implementing provisions of the Decree-Law 23 February 2020, No 6, bearing urgent measures in relation to the containment and management of the epidemiological emergency from COVID-19", published in the Official Journal 52 of 1 March 2020;

Given the decree of the President of the Council of Ministers 4 March 2020, bearing "Additional implementing provisions of the Decree-Law 23 February 2020, No 6, bearing urgent measures in relation to the containment and management of the epidemiological emergency from COVID-19, "It is not the first time that the European Union has been involved in this debate," he said.

Given the decree of the President of the Council of Ministers 8 March 2020, bearing "Additional implementing provisions of the Decree-Law 23 February 2020, No 6, bearing urgent measures in relation to the containment and management of the epidemiological emergency from COVID-19", published in the Official Journal 59 of 8 March 2020;

Given the decree of the President of the Council of Ministers 9 March 2020, bearing "Additional implementing provisions of the Decree-Law 23 February 2020, No 6, bearing urgent measures in relation to the containment and management of the epidemiological emergency from COVID-19, applicable throughout the country published in the Official Journal No.62 of 9 March 2020";

Given that the World Health Organization on 30 January 2020 declared the COVID-19 outbreak an international public health emergency;

In view of the decision of the Council of Ministers on 31 January 2020, which declared a state of emergency in the country for six months relating to the health risk associated with the onset of diseases arising from communicable viral agents;

Given the evolution of the epidemiological situation, the particularly widespread nature of the epidemic and the increase in cases in the country;

It considered necessary to take further measures in the area of containment and management of the epidemiological emergency from COVID-19;

In addition, given that the supranational dimensions of the epidemic phenomenon and the involvement of multiple areas in the country require measures to ensure uniformity in the implementation of the prophylaxis programmes developed at the International and European;

The Minister for Health has proposed that the Ministers of the Interior, Defence, Economy and Finance, as well as the Ministers of Infrastructure and Transport, Economic Development, Food and Forestry, Goods and Infrastructure, "It's not just a question of how much money we have to go about, but also how we can make it work," he said.

Decrees:

Art. 1
(Urgent measures to contain contagion across the country)

In order to counter and contain the spread of the COVID-19 virus, the following measures are taken throughout the country:

Retail activities are suspended,with the exception of the food and basic necessities activities identified in Annex 1, both in the neighbourhood and in the medium and large-scale retail areas, including in shopping centres, provided that access to only the above activities is allowed. Markets are closed, irrespective of the type of activity carried out, except for activities aimed at the sale of food only. Newsstands, tobacconists, pharmacies, parapharmacies remain open. In any case, the interpersonal safety distance of one meter must be guaranteed.

The activities of catering services (including bars, pubs, restaurants, ice cream parlours, bakeries), excluding canteens and catering continueor on a contractual basis, which guarantee the interpersonal safe distance of one meter. Only catering with home delivery is allowed in accordance with sanitation standards for both packaging and transport. Food and drink exercises in service and fuel areas located along the road, motorway and train stations, airports, lakes and hospitals, ensuring the interpersonal safety distance of one metre, also remain open.

Activities relating to personal services (including hairdressers, barbers, beauticians) other than those identified in Annex 2 are suspended.
Banking, financial, insurance and agricultural, agri-food processing services, including supply chains that provide goods and services, remain guaranteedin accordance with sanitation standards.

The President of the Region, by ordinance under Article 3, paragraph 2, of the Decree Act 23 February 2020 No. 6, may arrange the planning of the service provided by the local public transport companies,including non-linear, aimed at reducing and suppressing services in relation to the health interventions necessary to contain the coronavirus emergency on the basis of the actual needs and in order to ensure the essential minimum services. The Minister for Infrastructure and Transport, in consultation with the Minister of Health, can arrange, in order to contain the health emergency from coronavirus, the planning with reduction and abolition of interregional car services and rail, air and sea transport,on the basis of the actual needs and for the sole purpose of ensuring the minimum essential services.

In terms of production activities and professional activities, it is recommended that:

  • it is fully used by companies to use agile working modes for activities that can be carried out at home or in remote mode;
  • incentives are encouraged for employee leave and paid leave, as well as other tools provided for by collective bargaining;
  • activities of non-production-related business departments are suspended;
  • they assume anti-contagion safety protocols and, where it is not possible to respect the interpersonal distance of one meter as the main measure of containment, with the adoption of individual protectiontools;
  • sanitation of workplacesis encouraged, including by using social cushions for this purpose;
  • For production activities only it is also recommended that the maximum number of journeys within the sites be limited and access to common spaces restricted;
  • In relation to what is agreed in the number 7 and 8, the main focus is limited on productive activities between employers and trade unions.
  • For all non-suspended tasks, agile work modes are encouraged to be used as much as possible.

Art. 2
(Final provisions)

1. The provisions of this decree take effect from 12 March 2020 and are effective until 25 March 2020.

2. From the effective date of the provisions of this decree cease to have an effect, if incompatible with the provisions of this decree, the measures referred to in the decree of the President of the Council of Ministers 8 March 2020 and the decree of the President of the Council of Ministers 9 March 2020.

3. The provisions of this decree apply to the Special Statute Regions and the autonomous provinces of Trento and Bolzano in accordance with their respective statutes and implementation rules.
