Asiago Eco friendly: prohibited disposable plastics in public places

The new ordinance of the Municipality of Asiago prohibits the use of non-compostable plastic materials in parks, woods and other public places.

Asiago is committed to becoming more and more green and it does so with a new ordinance prohibiting the use in public places of non-compostable plastic materials.

The new ordinance, affixed from Monday to the pre-register of Piazza II Risorgimento and immediate efficacy, thus banning cutlery, plates and disposable glasses, as well as bags not biodegradable by parks, areas Woodland, squares, streets, schools and other public places of the commune.

You can only use-as the ordinance says-«cutlery, plates, glasses in biodegradable and compostable material, or disposable bags in biodegradable and compostable material, or bags Reusable (NET type, cloth, fabric, riclicata plastic). '

THE ORDINANCE

ORDINANCE NO. 36 OF 03-06-2019

Object:D ISPOSITIONS FOR THE MINIMIZATION OF PLASTIC waste ON THE Municipal Territory, THE INCREASE OF separate COLLECTION AND THE reduction OF THE environmental impact.

Given that:

 public administrations, in accordance with current legislation, have the obligation, in general, to prepare any action to prevent and reduce the quantities of waste and also to carry out actions aimed at the enhancement, study and The introduction of integrated systems to foster the maximum recovery of energy and material resources;

− In particular, the individual municipalities must undertake to meet the requirements of separate collection for the reuse, recycling and recovery of organic fractions and recoverable materials, considerably reducing the amount of waste Buc Iindifferentiated to be conferred on so-called landfill sites; Whereas, in the event of non-attainment of the objective laid down by the industry rules, the tariff on waste collection is intended to increase, with the burden of penalties for municipalities which do not meet the obligations envisaged;

 D. LGs. 152/2006 to art. 179es. IM, in defining the hierarchy for waste management, identifies as a priority the reduction of waste production at source, followed by the reuse of goods and subsequently the recovery of matter through the Recycling; the Artt. 179e180 stipulate that public administrations pursue initiatives aimed at respecting the hierarchy of waste treatment by favouring the placing on the market of products designed so as not to contribute to the As little as possible to increase the amount of waste produced/or in the field of activity;

− The European Parliament prohibits the use of disposable plastic items such as plates, cutlery, straws and cotton sticks within the l2021, a step forward towards the complete and definitive abandonment of all plastic materials; Awareness-raising aimed at consumers, young people, families on the risks associated with the massive presence of plastics, the advantages of the circular economy and how to reduce the use of plastics with the following prohibitions:

• Disposable plastic cutlery (forks, knives, spoons and chopsticks),
• Disposable plastic Plates,
• Plastic Straws,
• Cotton sticks made of plastic,
• Plastic Sticks for balloons,
• Oxy-degradable plastics, food containers and cups in polystyrene foam,

In addition to more constraints for manufacturers to ensure that by 2029, 90% of plastic bottles must be harvested/reused and plastic bottles must contain at least 25% recycled content by 2025 and 30% by 2030;

The deliberation of the Municipal council No. 84 of 20/05/2019 with which the municipal administration has provided a series of indications for the gradual and progressive prohibition, until the attainment of the objectives of the European Commission, The use of non-compostable plastics, introducing clauses that undertake, not only the institutional services of the institution such as school canters, public conferences, etc., but also all private subjects and establishing, in point 4) of the same Deliberation, the immediate issuance of a specific ordinance;

The general prohibition, in public places, of the use of non-compostable plastic materials, admitting exclusively cutlery, plates, glasses in biodegradable and compostable material, or disposable bags in biodegradable and compostable material , or reusable bags (NET type, cloth, fabric,

That this ordinance has immediate effect from its publication to the online register of the institutional site and its insertion in evidence on the homepage of the institutional site of the institution.
Whereas the execution, supervision of compliance with the provisions of this Ordinance and the assessment and imposition of penalties provide, as far as competence is available, the municipal police body, as well as any other agent or officer Judicial police to this enabled by the provisions in force.

Warns

Breach of this ordinance, save the application of art. 650 of the Penal Code or other general and special laws and regulations concerning the protection of the environment and public hygiene, shall be punished by the administrative penalties provided for in art. 7-bis of D. Lgs. N. 267/2000 from Euro25, 00 to Euro500, 00. Violers of the aforementioned obligation are admitted to the payment to a reduced extent consisting in the amount of €50 (fifty/00) to be effected within 60 days from the immediate dispute of the breach or by the Notification of the infringement pursuant to Article 6 of Legge689/1981.

Notification

Contrary to this Act, recourse to T.A.R. Veneto is permitted within 60GG. From the date of publication of the present, or exceptionally, within 120 days to the President of the Republic.
It shall also be forwarded, for appropriate knowledge and as far as the jurisdiction may be:
-At the local police command of the municipality of Asiago;
-The Trade and licensing Office of the municipality of Asiago;
-The tourist office of the municipality of Asiago;
-The Heritage and Environment Office of the municipality of Asiago;

-The Department of Preventionand the Pedemontana ULSS7;
-to the TenenzaG. d.F. Asiago;
-At the Confcommercio in Vicenza;
