Roana prohibits the use of firecrackers, drums and pyrotechnic Fireworks throughout the city

ORDER of 12/28/2016-ROANA

With the Ordinance n° 4 (reg. Gen. 51) of the 12/28/2016 the municipality of Roana prohibits the use of firecrackers, drums and pyrotechnic Fireworks throughout the city.

Below the text of the Ordinance:

SUBJECT: CONTINGIBILE AND URGENT ORDINANCE UNDER ART. 54 of
D.LGS. 267/2000 BAN on FIRECRACKERS, drums and
PIROTECN ICI ARTIFICES OF ANY KIND THROUGHOUT THE
MUNICIPAL AREA

Given that in recent years has increasingly spread the custom of celebrating the holidays and new year's Eve with the firing of firecrackers, drums and pyrotechnic devices of various kinds;

Each year nationally significant injury occur, arising at people in the use of such products;

Given that ignition and launch Fireworks, shooting firecrackers, cans and burst firecrackers and rocket fire has always been a cause of discomfort and the subject of complaints from many citizens, especially for uncontrolled use by people who often do not respect the minimum precautions of use;

Considering that the explosion of firecrackers, Fireworks and more, may cause damage to persons, damage to buildings, and fire hazard;

Considering also that the clanging of casks can determine, fright induced by noise and bright effects negative consequences for animals, leading frequently to escape and to lose orientation, thus exposing them to the risk of loss or investment and therefore endanger the urban security;

Considered exceptional drought situation also in the Woods and pastures, due to the lack of rainfall and snowfall patterns;

Having regard to the DL. # 91 of 2014 converted by law No 116 of 8/8/2014;

Visto l'art. 182 6/0° bis of DL. # 152/2006;

Having regard to articles. 46 and 57 of T.U.L.P.S. regarding material exploding;

Having regard to the art. 659-674-679 and 703 of the Penal Code;

Visto l'art. 50 of legislative decree 267/2000;

Viewed Regulation of sanctions for violation of the provisions of the regulations and municipal ordinances;

ORDER HERE

1. Effective immediately, it is strictly forbidden to all the municipality, in public places or open to the public as well as private place where pyrotechnic effects relapses may occur on public places are banned the firing of firecrackers, the explosion of firecrackers, barrels and pyrotechnic devices of various kinds and of all types, including those with luminante effect, although free sale;

2. In accordance with art. 3 c° 4 of law 8/7/1990 # 241, it is perceived that against this prowedimento, can be appealed to the regional administrative Court of Venice within 60 days. The publication pursuant to arts. 29 and 41 of the code of administrative procedure (Decree 104/2010), or alternatively extraordinary appeal to the head of State within 120 days pursuant to arts. 8 and 9 of the P.r.decree 11/24/1971 # 1199;

FEATURES

1. Unless the episode does not constitute a crime, failure to comply with obligations and prohibitions contained in this Ordinance will, pursuant to art. 7 bis of legislative decree 18
August 2000 # 267 enforcement of pecuniary administrative sanction of € 25.00 to € 500.00;

2. staff local police and other police service workers under art. 12 Of legislative decree # 285, enforcing 30.04.1992. this Ordinance;

3 this Ordinance is made known to the public through publication in the register Pretorio;
