Ordinance on prohibition of ignition of fireworks in the town of Asiago

Fire on Portule, the municipality of Asiago has the order n° 112 del 12/29/2015 on the prohibition of the ignition of fires of any kind, including Fireworks, throughout the city

PRESS RELEASE of the MUNICIPALITY of ASIAGO of 29 DECEMBER 2015

Just off the huge fire which affected the Val Renzola and part of Mount PortuleAsiago, the Town Council wishes to thank the police and particularly agents of the Forest Rangers and firefightersand Civil protection volunteers who, by acting promptly, cooperated actively and with great dedication in order to tame the flames.

Asiago thanks the President of the Veneto region, Luca Zaia and the regional advisers Roberto Ciambetti and Nicola Finco for direct involvement in the aircraft shut down fire involvement.

Right now, themunicipality of Asiago stands by security forces inidentifying the perpetrators of these vile acts, calling for the cooperation of citizens so that they can provide useful information on the outcome of the investigation.

The fire was of such proportions that could spill over into the Woods originally owned by the municipality of Asiago, that, to be considered, remained intact during the bombings of World War I, with irreversible damage to our heritage.

The Administration has taken every action taken to repress such phenomena and to create a deterrent effect against anyone intending to endanger thepublic safety andenvironmental integrity of our territory but also any legal proceedings aimed at protection of citizens who suffered the moral weight and payment of compensation for fault of this indescribable Act.

It is more necessary than ever today, observe carefully and scrupulous with the strictest rules of prudence that will not be repeated other tragic events of this kind, and that's why is extended to all the obligation to respect theOrdinance No 112/2015 which imposed the ban to light any kind of fire, including Fireworks.

The municipal administration of Asiago appeals to civic duty of everyone to prevent the risk of new fires, avoid more dangers to the health of our environment and protect all animals.

Ordinance No 112 of 12/29/2015-IGNITION Fireworks BAN

Subject: ORDINANCE CONTINGIBILE And URGENT-Prohibition Of IGNITING FIRES Of ALL KINDS And PYROTECHNIC TRICKS THROUGHOUT The CITY, Referring To A CONDITION Of MAXIMUM Danger For Fires.

THE MAYOR

The previous Ordinance # 109 of 28.12.2015.
Having regard to the note 11. 19887 of 29.12.2015 with which the Union welcomes the Decree of 7 Common Montana Regency Government of maximum danger for wildfires, issued by the regional civil protection, which implicitly prohibits the firecrackers on new year's Eve, Fireworks and any other situation that could favor the development of fires.
VISTO l'art. 50 of legislative decree 267 of 8/18/2000.
CONSIDERING that, for the State of continued scarcity of rain and very high maximum temperatures over the seasonal average and no snow day fire is very high throughout the city,
CONSIDERING also that the possibility of such facts would cause serious harm to public safety, traffic and private and public property,
SEEN the need to enact measures which apply to prevent and reduce the risk of fire, and protect, at the same time, the private and public safety
Invoke the rules of procedure by city police. SEEN on R.D. # 3267 of 30112/1923. ·

Having regard to Act No. 225 of 2/24/1992. VIEW ilD Decree. # 112 of 3/31/1998. Having regard to Act No. 353 of 11/21/2000.
CONSIDERED that the period of danger for wildfires can persist until the intervention of rain and/or snow,

STATE

the status of a serious fire hazard for all wooded areas and grazing land around the municipality. Anyone spotted a fire that affects or threatens wooded areas and pastureland, including any populated structures and infrastructures located inside these areas, shall give immediate notification to the local authorities by reporting any relevant territorial element for the correct location of the event.

ORDER HERE

In addition to the rules contained in Royal Decree No. 3267 of 12/30/1923, its Rules and regulations and forest police, as well as of article 3 of law no 353/2000, during the period of severe fire hazard, in all areas of the municipal area at risk of forest fire (a1t. 2 of law 353/2000) and/or immediately adjacent to them , the

ABSOLUTE PROHIBITION

l. to LIGHT FIRES in the Woods, fields, parks and near public buildings.

2. to perform all transactions under art. 11 Urban regulation police (it's forbidden to burn the dry grass of the lawns and other plant debris around the area of jurisdiction except in special cases and with the approval of the Mayor, in any case, the above must be done in accordance with the 24-25-26-27 ari, prescriptions and Forest of the Veneto region. Infringements are punished in accordance with [article 3 of Act 9. 10.1967 # 950 e successive modificazioni ed integrazioni (l. 4,711,975 and L. 424/1984) and if one has followed the guilty forest damage is obliged to pay damages.

In accordance with art. 3-paragraph 4 of law no 241 of 1990, against this Ordinance/07108, anyone who is interested may resort within sixty days from the date of publication or notification, at T.AR. Veneto — extraordinary appeal may be proposed to the President of the Republic in accordance with art. 8 of P.r.decree November 24, 1971, # 1199 within dicentoventi days from the date of the publication term and/or notification of the measure.

In accordance with art. 4 of law no, 24/90 the person responsible for the proceedings is Mr. Andrea Pinaroli, Deputy Commander of the local police of Asiago.
